Patrick McMahon Can Explain Dischargeable and Non-Dischargeable Debt

Your federal tax debt, for instance, can be discharged if your tax return was due more than three years before you filed for bankruptcy. Your return should have been filed two years prior, and taxes assessed for roughly eight months, or 240 days, before the filing.

Recent bankruptcy laws state that an automatic stay is no longer possible in divorce or support actions filed in state courts. Child support issues can be addressed without the need to request a lifting of the stay in federal bankruptcy court.

Chapter 13 allows for school loan creditors to be paid over time. Your lenders can take no action against you during that time span. You can be relieved of these financial pressures for up to five years. We can also try to establish “hardship” on your behalf, so that student loan debt can be made dischargeable.

Are taxes, child support or student loans frustrating your attempts at personal, family or business financial recovery? Our bankruptcy law firm can help you. Be in touch with us in San Francisco as soon as you can.
